XBIZ LA 2010 Slated for Feb. 9-11 at Hollywood’s Sofitel

HOLLYWOOD, Calif. —XBIZ is pleased to announce dates for XBIZ LA 2010, an annual business-to-business trade event that explores current and emerging market trends, technologies and business solutions for the adult entertainment industry.

AdamAndEve.com Revamps Affiliate Website

HILLSBOROUGH, N.C. — Adam & Eve’s affiliate program, AdamEveCash.com, has been revamped.

Among the new features is a product data feed for more than 4,000 adult products available online. The affiliate program also now offers affiliate-training programs for all levels of experience with PDF training documents, graphics and charts.

Affiliate promo tools, including multiple options for banners and text links, also have been added.

Bankruptcy Judge Schedules AEE Parent’s Bidding Plan

NEWTON, Mass. — A federal bankruptcy judge on Monday scheduled the auction of substantially all the assets of the parent company of Adult Entertainment Expo.

Questex Media filed for bankruptcy earlier this month in order to restructure its ballooning debt. In its Chapter 11 filing Questex listed assets of $299 million against liabilities of $321 million.

Questex acquired AEE when it purchased various divisions of Advanstar for $185 million in 2005, of which Home Entertainment Events — managers of the show — was a part of.

U.S. Judge Mary Walrath scheduled the auction on Nov. 20 and a sale hearing on Nov 24.

Questex filed a motion earlier this month saying it had received a bid of $120 million from QMG Acquisition LLC — its senior lenders — and sought the sale of all its assets through a court-supervised 363 sale.

With a 363 sale, assets are conveyed to the purchaser free and clear of any liens. Those liens will then be attached to the net proceeds of the sale and paid as ordered by the bankruptcy court.

Walrath, in her motion to approve the bulk sale auction, ordered the company to publish bidding procedure notices in the Wall Street Journal no later than Friday.

AEE spokesman Sean Devlin told XBIZ that the 2010 show is in full-production mode and that Questex’s Chapter 11 filing “will have no impact on the daily operations of the company at the operating level, and thus no impact at all on AEE.”

“Rather than having any adverse impact on future expos, this will only serve to strengthen the event’s position in the marketplace.”

Questex publishes 23 print magazines and sponsors 28 conferences. It also has more than 150 trade websites.

Signbucks Daily Lists All Active CCBill Programs

CYBERSPACE — Adult affiliate program directory Signbucks Daily has announced the completion of its listing of all currently active CCBill programs.

According to Daizzzy of Signbucks Daily, the listing examines 12,000 paysites across nearly 2,800 programs on different platforms, and sets a new record for “explored” adult affiliate sponsors. The project took almost a year to complete and focused on CCBill programs because “CCBill is the most stable affiliate platform and most trusted adult billing [company].”

“Over that time we have checked each of 40,000 CCBill clients accounts (CA) which are set for each separate program, processed active ones and listed them into the directory,” Daizzzy said. “We got nearly 2,400 active programs with 4500 paysites. We will continue to monitor that system for new sponsors and sites to promote as well as changes in current ones.”

“We listed all active programs, no matter if have they commission for referring other webmasters (called a “partner bonus program” in the CCBill AP), or not,” Daizzzy added. “The current ratio is 30 to 70 percent, accordingly.”

The study found that most of the CCBill based programs were not saturated, and offer frequent exclusive content updates; which makes them a great substitute for oversaturated programs promoted on adult boards.

“Nowadays many of these well-know programs are into phony marketing on a very huge scale,” Daizzzy said. “By getting a big list of quality programs (trusted because of CCBill) it gives all of us a chance to move the industry to business based on common sense — So a customer gets what he’s promised without being charged for services he hasn’t acknowledged and didn’t purchase.”

For owners of these lesser-known programs, a listing in the Signbucks Daily directory is an easy way to build a stronger affiliate base, while affiliates will find the listing useful in today’s competitive environment.

“By exploring paysites in each niche we give webmasters an opportunity to go deeper into it, which is a great long-term business model strategy in this tube-era,” Daizzzy concluded. “It’s obvious that tubes, warez sites and other illegal sites won’t be able to cover a micro niche as well as a specialized site.”

NETbilling Adds Debit Solution Support

Ruling Likely to Upset Obscenity Prosecutions

SAN FRANCISCO — Wednesday’s ruling by the 9th U.S. Circuit Court of Appeals, which decided that a national community standard to define Internet obscenity is more appropriate than a local one, is likely to upset government prosecutions.

Gary Jay Kaufman of The Kaufman Law Group, who argued the 9th Circuit case along with Greg Piccionelli of Piccionelli & Sarno, told XBIZ that the opinion in a nutshell makes the Miller test obsolete as to Internet and email obscenity prosecutions in the jurisdiction of the 9th Circuit, which is the second-highest court in the nation covering the Western states.

The Miller test, developed in the 1973 case Miller vs. California, looks at three points for obscenity prosecutions. The test asks whether the work as a whole appeals to the prurient interest, whether the work is patently offensive and whether the work lacks serious literary, artistic, political or scientific value.

Kaufman said that with the ruling prosecutors will have to work much harder reaching a conviction.

“Now the most conservative jurisdictions will no longer be able to dictate what is acceptable for the rest of the country,” he said.

Kaufman said that the government now can’t cherry pick jurisdictions in which they think they can obtain a conviction based upon the standards of that local community.

“Now, even if a case is brought in a very conservative jurisdiction, the jury will be instructed that they must apply standards for obscenity, outside of their community – i.e. what is accepted generally on the Internet nationwide,” he said.

But the Los Angeles-based industry attorney said that with a national standard it still is feasible for a jury hearing in an Internet obscenity case.

“ I also believe that it would be next to impossible for a court to articulate exactly what that standard is,” he said. “Each jury will have to decide a case based on testimony and evidence as to what are the standards nationwide and on the Internet.

“This can be done by expert witnesses as well as simple demonstrations by counsel to the jury.”

On Thursday, it wasn’t clear whether the U.S. Attorney’s Office would appeal the ruling to the U.S. Supreme Court. XBIZ calls to the agency weren’t returned by post time.

The case is U.S. vs. Jeffrey Kilbride and U.S. vs. James Schaffer, 07-10528.

Metro Money Adds MetroXXX.com to Portfolio

Mozilla Releases New Version of Camino Web Browser

NEW YORK — After a long wait, the second version of Mozilla’s Mac-based Camino web browser has arrived.

Since its inception, Camino has enjoyed a small (but loyal) following among Mac enthusiasts who praise its lightweight programming and overall speed, especially when compared to competing browsers.

“Camino, though much less prevalent than its Mozilla sibling, Firefox, has a solid following among Mac users who appreciate its speed,” tech analyst MG Siegler said. “It has long been my browser of choice as it’s relatively lightweight and very fast compared to Firefox. And compatibility with various sites seems better than Apple’s own Safari.”

The new release is technically a release candidate — a preliminary version of the browser that will be made available for widespread bug testing. If no major problems are found, Mozilla will name this the official release.

The new version of Camino doesn’t offer private browsing, or “porn mode,” but it does include an “annoyance” feature that prevents websites from moving or resizing windows. In addition, users can control the color scheme of Camino.

Sky.tv Omits Adult Channels on New XBOX Service

LOS ANGELES — Sky.tv, an online entertainment service, has inked a deal to deliver content to the XBOX 360, but the company has yet to include porn in that deal.

Microsoft’s XBOX 360 offers a variety of video content, including many channels from providers like Sky.tv, which is calling its channel the Sky Player service, which will replicate the video offerings of its online presence.

Except for adult. As of now, Sky.tv offers three adult channels: Television X, Adult Channel and the Playboy Channel. None of those channels will be available through the Sky Player service on the XBOX 360.

Sky.tv’s Griff Parry didn’t rule out the possibility of the channels coming to the XBOX, he said it wasn’t likely.

“No plans at the moment,” he said. “I suspect it’s quite unlikely. But it’s always possible.”

At launch of Sky Player, 24 non-adult channels will be available. The company plans to bring the service to the PlayStation 3 next.
